A freedom-to-operate (FTO) analysis assesses whether making, using, selling, importing, or otherwise commercializing a particular product or technology could potentially infringe third-party patent rights in a defined jurisdiction. It is a forward-looking risk assessment for a specific product, process, or planned activity, rather than an assessment of whether the company itself can obtain a patent.An FTO analysis generally focuses on unexpired and potentially enforceable patent claims that read on the relevant product or process. It considers the applicable jurisdiction, patent family, legal status, claim scope, and relevant dates, and identifies patents that may require further legal review, licensing, modification, or design-around. An FTO search cannot guarantee that no relevant patent exists; unpublished applications, incomplete databases, uncertain legal status, and patents outside the defined search scope can create residual risk.
